Phil Rubin- House District 40

Rep. Phil Rubin represents North Carolina’s House District 40 in Wake County, bringing extensive legal experience as a former federal prosecutor and Special Deputy Attorney General. A Raleigh resident and Duke Law graduate, he is focused on constitutional law, public safety, and protecting North Carolinians’ rights.

Phil Rubin is a Democratic member of the North Carolina House of Representatives, representing District 40 in Wake County. Appointed on January 29, 2025, to fill the vacancy left by the late Rep. Joe John, Rubin brings a wealth of legal experience to the legislature.

Rubin graduated magna cum laude from the University of Georgia and summa cum laude from Duke University School of Law, where he served as editor-in-chief of the Duke Law Journal. His professional background includes clerking for Chief Judge David Sentelle of the U.S. Court of Appeals for the D.C. Circuit, practicing at Covington & Burling, and serving as an Assistant U.S. Attorney in the Eastern District of North Carolina. Prior to his legislative appointment, he was a Special Deputy Attorney General at the North Carolina Department of Justice, focusing on constitutional litigation and child safety.
